Legal Basis: Legitimate Interest
If you provide your personal data by filling out a form and express your interest or intention to engage with us, we consider this as part of the preparation of a contract. In this case, the legal basis for processing your personal data becomes our legitimate interest under the GDPR. This change in legal basis does not affect your rights or how we handle your data; it only means that during the contract preparation phase, unless you request to terminate the process, we continue to process your personal data for the purpose of preparing and potentially entering into a contract.
Legal Basis: Contract
If you pay for any of our services, your payment is made under the terms and conditions outlined in our General Terms and Conditions. In this case, the legal basis for processing your personal data is the performance of a contract under the GDPR. This change in legal basis does not alter your rights or the way your personal data is processed; it simply means that during the term of the contract, even if you withdraw your consent, we will continue to process your personal data as necessary to fulfill the contract.
Once the contract is fulfilled or terminated, the legal basis for processing your personal data changes again, and we will process your data in accordance with legal obligations.
Following Contract Termination or Fulfillment – Based on Legal Obligation
In relation to the data included on issued invoices, we are legally required to continue processing your personal data in accordance with applicable legislation.
Your Rights
You are entitled to the rights listed below. In accordance with the GDPR, we are required to respond to your request within one month. We will do our best to respond even sooner.
Right to Information
You have the right to request information about the personal data we process about you. You may also request access to this data.
You may request information in writing at any time by sending a registered letter with return receipt to our postal address, or by sending an email to our official email address. We consider a written request valid if we can clearly identify you based on the information provided.
We consider an email request valid only if it is sent from your registered email address. However, this does not exclude the possibility that, for security reasons, we may ask for additional identification before providing the requested information.
Your request for information may include details about the data we process, the source of the data, the purpose and legal basis of processing, the duration of data storage, the names and addresses of any data processors, the processing activities performed, and, in the case of data transfers, who received or will receive your personal data and for what purpose.
Right of Access
If you request confirmation as to whether your personal data is being processed, and the answer is yes, you are entitled to access information regarding the purpose of processing, categories of data, recipients, duration of storage, your data subject rights, legal remedies, source of data, any automated decision-making, and any international data transfers.
Right to Rectification
You may request the correction or modification of your personal data at any time by sending a registered letter with return receipt to our postal address or an email to our official email address. Considering the purpose of the processing, you may also request that incomplete personal data be completed.
Right to Erasure (Right to be Forgotten)
You may request the deletion of your personal data processed by us. Deletion may be refused (i) in order to exercise the right to freedom of expression and information; (ii) if the processing is required for reasons of public interest (as authorized by law); or (iii) if justified by legitimate private interests (such as the establishment, exercise, or defense of legal claims).
If we must refuse your deletion request, we will inform you of the reason for the refusal. Once your deletion request is fulfilled, the previously deleted data cannot be restored.
You can unsubscribe from newsletters at any time using the unsubscribe link provided in each email.
Right to Restriction of Processing
You may request the restriction of processing your personal data if you contest the accuracy of the personal data. In such cases, the restriction will apply for the period necessary to verify the accuracy of the data.
We will mark the data in question as restricted if its accuracy or correctness is disputed, but it cannot be clearly determined whether the data is inaccurate.
You may also request that we restrict the processing of your personal data if the processing is unlawful but you oppose the deletion of the data and instead request that its use be restricted.
This right may also be exercised if the purpose of the processing has been fulfilled, but you require the data to be retained for the establishment, exercise, or defense of legal claims.
If you object to the processing of your personal data, we will restrict the processing for the period necessary to determine whether the legitimate grounds of the controller override your own legitimate interests.
Right to Data Portability
You may request that the personal data you have provided to us and which is processed by automated means be delivered to you in a structured, commonly used, machine-readable format (e.g., XML, XLS, CSV), and/or that it be transmitted directly to another data controller upon your request.
Right to Object
You have the right to object to the processing of your personal data if:
(i) the data is processed solely to fulfill our legal obligations or for the purposes of our legitimate interests;
(ii) the purpose of processing is direct marketing, public opinion polling, or scientific research; or
(iii) the processing is carried out in the public interest or in the exercise of official authority.
We will assess the lawfulness of your objection, and if we find it well-founded, we will terminate the processing and restrict access to the personal data in question. Web Analytics on the Website
We inform you that to measure the traffic on https://frucreativedesign.com/, to monitor visitor behavior, compile statistics, and assess the effectiveness of our advertisements, we use the following programs: Google Analytics, Google Remarketing, Google AdWords Conversion Tracking, and Facebook Remarketing.
These programs place so-called cookies in your browser, which store unique user identifiers. By visiting our website, you consent to the use of Google Analytics, Google Remarketing, Google AdWords Conversion Tracking, and Facebook Remarketing. You also agree to the monitoring and tracking of your behavior, and to the use of all services provided by these programs.
Nonetheless, you have the option at any time to disable the recording and storage of cookies for the future, as described below. We inform you that the configuration and use of Google Analytics, Google Remarketing, Google AdWords Conversion Tracking, and Facebook Remarketing are fully compliant with the requirements of data protection authorities.
According to Google, Google Analytics primarily uses first-party cookies to report on user interactions on websites. These cookies only record non-personally identifiable information. Browsers do not share their own cookies across domains. Further information about cookies can be found in Google’s Advertising and Privacy FAQ.
Google Fonts
We inform users of our website that we use Google Fonts, which are widely accepted in web design and font delivery.
Please note that the fonts used on our website are loaded through the Google Fonts service and are not hosted locally. This means that when you open our website, your browser establishes a direct connection with the servers of Google LLC (1600 Amphitheatre Parkway, Mountain View, CA 94043, USA), during which your IP address may be transmitted to the United States.
This is technically necessary to display the fonts correctly but is considered a transfer of personal data to a third country from a data protection perspective.
Google guarantees an adequate level of data protection through the use of Standard Contractual Clauses approved by the European Commission.
If you do not wish your IP address to be transmitted to Google, we kindly ask you not to use our website or to use a browser setting or plugin that blocks external content loading.
Google Analytics
We primarily use the Google Analytics service for generating statistics, including measuring the effectiveness of our campaigns. Through this program, we obtain information such as how many visitors have accessed our website and how much time they have spent on it. The program identifies the visitor’s IP address, which allows it to determine whether the visitor is new or returning, and to track the navigation path the visitor follows on the website.
By using our website, you consent to the use of Google Fonts and Google Analytics, as well as to the collection and processing of your data for the purposes mentioned above. If you do not wish Google Analytics to collect your data, you may disable it using the browser add-on provided by Google.
Google AdWords Conversion Tracking
The purpose of Google AdWords Conversion Tracking is to enable the business to measure the effectiveness of its AdWords advertisements. This is done through cookies placed on the user’s computer, which remain active for 30 days.
Cookie Policy
Our website uses cookies to ensure proper functionality, enhance the user experience, and collect data for statistical and marketing purposes.
Cookies can be categorized as follows:
-
Necessary (functional) cookies – essential for the operation of the website and its convenience features (e.g., saving language preferences).
-
Statistical cookies – collect anonymous information about visitor behavior.
-
Marketing cookies – enable the display of targeted advertisements.
You can find detailed information about our use of cookies in the Cookie Policy. On the website, you can customize or withdraw your consent at any time using the cookie banner.
Disabling Cookies
If you would like to manage or disable cookie settings, you can do so in your browser. This option is typically found in the browser’s toolbar under the section for cookies/tracking preferences. In most browsers, go to Tools > Settings > Privacy settings to define which tracking functions you allow or block on your device.
If you do not want Google Analytics to generate reports on your visits, you can install the Google Analytics opt-out browser add-on. This extension instructs the Google Analytics JavaScript scripts not to send visit information to Google. If you install the opt-out add-on, you will also be excluded from content experiments.
To disable Google Analytics tracking across the web, visit the Google Analytics opt-out page and install the browser extension. For more information on installing or removing the add-on, refer to your browser’s help section.
Principles of Data Processing
The Data Controller processes personal data in accordance with the principles of good faith, fairness, and transparency, as well as in compliance with applicable laws and the provisions of this Privacy Policy.
The Data Controller uses personal data that is strictly necessary for the provision of services solely based on the data subject’s consent and exclusively for the intended purposes.
The Data Controller processes personal data only for the purposes defined in this Privacy Policy and in the relevant legal regulations. The scope of processed personal data is proportionate to the purpose of data processing and does not extend beyond it (data minimization).
We do not process personal data of individuals under the age of 18.
The Data Controller does not disclose personal data to third parties, except for data processors specified in this Privacy Policy and, in specific cases mentioned herein, to external service providers. An exception to this rule is the use of anonymized, aggregated statistical data, which does not contain any personally identifiable information, and therefore does not qualify as personal data processing or data transfer.
In certain cases—such as official court or police inquiries, legal proceedings related to copyright, property, or other rights violations or the suspicion thereof, threats to the Controller’s interests or the provision of services—the Data Controller may grant access to the personal data of the affected user to third parties.
The Data Controller’s system may collect data on user activity, which cannot be linked to other data provided by the users during registration or data generated by the use of other websites or services.
The Data Controller informs the data subject and all parties to whom the personal data was previously disclosed of any rectification, restriction, or deletion of the personal data. This notification may be omitted if it does not harm the legitimate interest of the data subject, taking into account the purpose of the processing.
The Data Controller ensures the security of personal data and implements appropriate technical and organizational measures and procedural rules to protect the collected, stored, and processed data and to prevent accidental loss, unlawful destruction, unauthorized access, use, modification, or disclosure. The Data Controller also requires all third parties receiving personal data to fulfill this obligation.
In accordance with the relevant provisions of the GDPR, the Data Controller is not required to appoint a Data Protection Officer.
The Data Controller is responsible for compliance with these principles.
Confidentiality of Data Processing
We handle all recorded data confidentially and take all necessary measures to ensure their security. Your data is used solely for the proper operation of the website, which includes, among other things, sending emails and SMS messages to the contact details you have provided. In such cases, messages are sent through the respective service provider.
We will never sell or rent your personal data to third parties for marketing purposes. However, if required by subpoena, court order, or as part of legal proceedings, we may disclose your personal data and other relevant information.
Access to Personal Data by Our Employees
Our employees are granted access only to the personal data necessary for the performance of their work. All access is logged, and access to data export functions is strictly limited.
Data Transfers
We are authorized and obligated to forward any available and lawfully stored personal data to the competent authorities if such data transfer is mandated by law or binding authority decision. The Data Controller cannot be held liable for such data transfers or their consequences.
If we transfer the operation or utilization of our service, either partially or fully, to a third party, we may also transfer your personal data to the new operator without requesting separate consent, but only after providing appropriate prior notice. Such transfer must not place you in a more disadvantageous position than that defined in this Privacy Policy. Before the transfer, you will be given the opportunity to object. If you object, the data transfer under this clause will not take place.
The Data Controller maintains a record of data transfers for the purposes of verifying legal compliance and informing the data subject. This record includes the date of transfer, the legal basis and recipient of the transfer, the categories of personal data transferred, and any other required details as per applicable data protection regulations.
Privacy Policy Updates and Monitoring Legal Changes
The Data Controller regularly reviews and updates this Privacy Policy in accordance with changes in legislation and regulatory expectations. The current version of the Privacy Policy is always available to users under the “Privacy Policy” section of the website.
